Refund & Returns Policy

[Kraken] ("we," "us," "our") operates this store and ships to customers worldwide. By placing an order, you confirm that you have read, understood, and agree to this policy.


1. All Sales Are Final

To the fullest extent permitted by the law of your country, all sales are final. We do not offer refunds, returns, exchanges, or store credit for:

  • Change of mind, buyer's remorse, or no-longer-wanted items
  • Ordering the wrong item, size, quantity, variant, or color
  • Failure to read the product description, specifications, or images before purchase
  • Items that have been used, opened, worn, washed, altered, or are missing original packaging
  • Personalized, custom-made, made-to-order, perishable, intimate, or hygiene-sealed products
  • Digital products or downloadable goods once access has been provided
  • Promotional, clearance, "final sale," or discounted items

We are not obligated to provide a refund except where a non-waivable legal right applies (see Section 6).


2. Fraud and Unauthorized Activity

Losses arising from fraud, scams, account compromise, sharing of payment details, or unauthorized use of your payment method are the responsibility of the cardholder/account holder and are not eligible for a refund from us. We reserve the right to cancel, hold, or refuse any order we reasonably suspect to be fraudulent, and to report suspected fraud to the relevant authorities and payment providers.

Initiating a chargeback or dispute that we can demonstrate to be invalid or fraudulent may result in account suspension and may be pursued for recovery of costs.


3. Delivery, Risk, and Third-Party / Gift Purchases

  • You are responsible for providing a complete and accurate shipping address. We are not liable for non-delivery, delays, or loss caused by an incorrect or incomplete address, a refused delivery, or an unclaimed parcel.
  • Where you purchase an item to be sent to another person (a gift or third-party recipient), you accept that delivery to that recipient discharges our obligation. We are not responsible for the recipient's acceptance, use, or rejection of the item, and a recipient's change of mind is not grounds for a refund.
  • Once an order is marked as delivered by the carrier, or signed for where signature is required, it is considered received.
  • Customs duties, import taxes, and brokerage fees are the buyer's responsibility and are non-refundable.

⚠️ Important note for you (the merchant), not for the policy: in most countries and under card-network rules, the seller bears the risk of loss until the item is actually delivered, and "item not received" disputes are decided by the bank — not by this clause. See the chat message for detail.


4. Damaged, Defective, or Incorrect Items

If your item arrives damaged, defective, or materially not as described, contact us at [ryan@krakenreselling.com] within [e.g. 48 hours / 7 days] of delivery with your order number and clear photo/video evidence. Where we confirm a fault that is our responsibility, we will, at our discretion and as required by applicable law, provide a repair, replacement, or refund. This does not apply to damage caused by misuse, accident, or normal wear.

6. Your Statutory Rights

  • EU / EEA: a 14-day right of withdrawal for most distance (online) purchases, and a legal guarantee for non-conforming goods.
  • United Kingdom: a 14-day cooling-off period under the Consumer Contracts Regulations and rights under the Consumer Rights Act for faulty or misdescribed goods.
  • Australia: consumer guarantees under the Australian Consumer Law for goods that are faulty, not as described, or not fit for purpose, which cannot be excluded.
  • Other jurisdictions: equivalent non-waivable consumer rights may apply.

Where such a right applies, it overrides any conflicting term in this policy.

We may update this policy at any time. The version in effect at the time of your order applies to that order.
